1. About NightlyTales

NightlyTales ("we", "us", "our") is an AI-powered bedtime story service that delivers personalised stories to subscribers via email. By using our service you agree to these terms.

2. Eligibility

You must be at least 18 years old to create an account. NightlyTales is intended for parents and guardians to use on behalf of their children.

3. Subscription and Billing

NightlyTales offers a free tier and a paid Premium subscription
Premium is billed monthly at the current listed price (currently AUD equivalent of USD $8/month)
Payments are processed securely by Stripe
Subscriptions renew automatically unless cancelled
You may cancel at any time from your account settings — cancellation takes effect at the end of the current billing period
We do not offer refunds for partial months

4. Free Tier

The free tier provides 3 stories per week as standalone stories with no continuity between nights. We reserve the right to modify free tier limits at any time with reasonable notice.

5. AI-Generated Content

Stories are generated using artificial intelligence. While we work hard to ensure stories are age-appropriate, positive, and high quality, we cannot guarantee that every story will meet every family's expectations. If you receive a story you find inappropriate, please contact us immediately at hello@nightlytales.com.

6. Your Child's Data

We collect your child's first name, age, and interests solely for the purpose of personalising their stories. We do not share this information with third parties. Please see our Privacy Policy for full details.

7. Acceptable Use

You agree not to share your account with others or resell access to the service. Each account is for one family.

8. Intellectual Property

Stories generated for your child are for your personal, non-commercial use. You may print or save stories for your own family's enjoyment but may not reproduce or distribute them commercially.

9. Service Availability

We aim to deliver stories reliably every night, but we do not guarantee uninterrupted service. Occasional delays or missed stories may occur due to technical issues. We will not be liable for any such interruptions.

10. Australian Consumer Law

Our service comes with guarantees under the Australian Consumer Law that cannot be excluded. Nothing in these terms limits your rights under the Australian Consumer Law.

11. Limitation of Liability

To the maximum extent permitted by law, NightlyTales will not be liable for any indirect or consequential loss arising from your use of the service.

12. Changes to These Terms

We may update these terms from time to time. We will notify you by email of any material changes. Continued use of the service after changes constitutes acceptance.
